Tragedy in Tempi: Objection to invalidity of the experts’ conclusion on the new videos filed by lawyers of relatives

An objection to the invalidity of the report of the two forensic experts on the videos delivered by the lawyer of Interstar on February 5 to the appellate court was filed by the lawyers of the relatives of the victims of the Tempi tragedy.

Sessions of the Appeals Council are underway following an appeal by Mr. Psaropoulos, who is a lawyer and father of a victim of the Tempi tragedy. Mr. Psaropoulos filed an appeal in order to upgrade the indictment for the two Hellenic Train executives who are currently being prosecuted for misdemeanor manslaughter.

In his appeal, he asks that the two executives be prosecuted for the felony of disrupting transportation security.

It is unknown whether the Council will issue its decision today.

Invalidity objection

At the same time, objection of invalidity was filed by Giannis Mantzouranis, counsel for the victim’s father. The objection was made to the conclusion of the forensic experts regarding the videos delivered by the lawyer of the OSE security company on February 5.

Mr. Mantzouranis filed the objection because the two forensic experts were appointed without a prior prosecutorial proposal, the prosecuting parties were not informed to appoint their technical advisers and the process was fast-tracked.

In addition, he argues that the case is discrete, meaning the same forensic experts did not need to be the same as those who drafted the conclusion for the deadly train accident in Tempe that was delivered in June 2023.

In their opinion, the experts say that the freight train that collided with the passenger train in Tempe is the same train shown in the three new videos that were delivered to the investigator by the security company’s attorney.

The two experts in their reports, among other things, say that the commercial train does not show any cargo other than what was declared, ruling out suspicious cargo.
